Terms & Conditions

MKTSignals AutoPilot provides:

• Automated trading signals based on predefined strategies
• Integration with the Exante broker for order execution
• Real-time notifications via Telegram
• Dashboard for monitoring and managing strategies
• Analysis and performance tracking tools

The integration with the Exante broker is carried out through limited execution permissions, without MKTSignals having access to withdraw funds or make transfers from the user's account.

Note: The Service may be modified, updated or discontinued at any time, with no obligation to maintain previous features.

By using the Service, the User agrees to:

• Provide accurate and up-to-date information during registration
• Maintain the confidentiality of their access credentials
• Accept that any access carried out with their credentials is their sole responsibility
• Correctly configure their Exante API credentials
• Regularly monitor their trades and configurations
• Comply with all applicable laws and regulations in their jurisdiction
• Not use the Service for illegal or unauthorised activities
• Assume full responsibility for all trading decisions made

The User acknowledges that:

• The Service is provided "as is" and "as available", without warranties of uninterrupted operation, freedom from errors or accuracy of data
• The proper functioning of the Service depends on external systems (such as the broker, data services and connectivity). MKTSignals does not guarantee their availability or accuracy

MKTSignals and its affiliates shall NOT be liable for:

• Financial losses resulting from the use of the Service
• Errors in trading signals or order execution
• Service interruptions or technical issues
• Actions or omissions of the Exante broker
• Losses due to unauthorised access to the User's account
• Investment decisions based on the information provided
• Indirect, incidental or consequential damages

Maximum liability limits:

• In no event shall MKTSignals' total liability exceed the amount paid by the User in the previous 12 months
• In no event shall MKTSignals be deemed an investment manager or an entity under the supervision of the CNMV, given that its function is limited to the automated execution of orders configured by the User

Legal notice: MKTSignals AutoPilot is a technological execution tool. It does not provide investment services or portfolio management under the Securities Market Act (MiFID II).

The User agrees to:

• Use the Service only for lawful and authorised purposes
• Not attempt to access other users' accounts
• Not interfere with the operation of the Service
• Not reverse-engineer the software or algorithms
• Not share their credentials with third parties
• Immediately report any security vulnerability
• Not use the Service to offer commercial services to third parties without written authorisation from MKTSignals

Prohibition on third-party account management:

It is expressly prohibited to use the Service to manage, invest or execute trades in third-party accounts, or to offer management, advisory or copy-trading services to other investors using MKTSignals AutoPilot.

The Service is intended exclusively for personal, non-commercial use by the registered account holder.

Any use of the Service for third-party capital management purposes requires prior written authorisation from MKTSignals and may constitute an activity subject to financial regulation.

MKTSignals is committed to:

• Treating your personal data confidentially
• Processing personal data in accordance with Regulation (EU) 2016/679 (GDPR) and applicable Spanish legislation
• Storing API credentials in encrypted form (AES-256)
• Not sharing personal information with third parties without your consent
• Using industry-standard security measures
• Responding to requests for deletion of personal data

Limitation:

• The User acknowledges that no security measure is absolute and that risks arising from cyberattacks, unauthorised access or technical vulnerabilities may exist

• Pricing details are available on the subscriptions page
• Payments are processed securely
• Subscriptions renew automatically unless cancelled
• No refunds are offered for partial periods
• We reserve the right to modify prices with prior notice
• Fees and services may vary if the costs or terms of external providers (such as the broker or data services) change

• All content, software, algorithms, trademarks and materials of the Service are the exclusive property of MKTSignals and are protected by intellectual property laws
• The User does not acquire any rights over these elements beyond the authorised use of the Service
• If the User publishes or shares content through the Service ("Shared Content"), the User grants MKTSignals and other users a worldwide, non-exclusive, royalty-free, sublicensable and irrevocable licence to use, reproduce, modify, distribute and display such content for purposes related to the Service

MKTSignals may suspend or terminate the User's access:

• For violation of these Terms and Conditions
• For fraudulent or illegal activities
• For failure to pay applicable fees
• At MKTSignals' discretion, with prior notice, or for technical, regulatory or commercial reasons, even if the User has not breached any terms

MKTSignals shall not be liable for any losses or damages arising from the suspension or termination of the Service.

Note:

• The User may cancel their account at any time from the dashboard
• Certain provisions (such as limitation of liability, indemnification and licences over shared content) shall survive termination

The User agrees to indemnify and hold harmless MKTSignals, its officers, employees and affiliates, and to cover any claims, losses, damages or expenses (including legal fees) arising from the User's use of the Service or violation of these Terms.

MKTSignals reserves the right to modify these Terms and Conditions at any time. Amendments shall take effect immediately upon publication. Continued use of the Service constitutes acceptance of the modified terms.

• The User agrees that all notifications, notices and communications shall be made by email to the address registered with their account
• Such communications shall have the same validity as a written notice on paper

If any provision of these Terms is found to be invalid, illegal or unenforceable, the remaining provisions shall remain in full force and effect.

• Any comments, ideas or suggestions submitted by the User ("Feedback") may be freely used by MKTSignals
• The User understands that there shall be no obligation of compensation or acknowledgement for such use

• These Terms shall be governed by and construed in accordance with the laws of Spain
• Both parties expressly agree to submit to the courts of Barcelona (Spain) as the sole competent jurisdiction
• The User expressly waives any other jurisdiction that may apply
